These Terms of Use ("Terms") govern your access to and use of the DialogFusion website (dialogfusion.com) and platform (app.dialogfusion.com), including all related features, integrations, tools, and services (collectively, the "Service") provided by DialogFusion ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you use the Service on behalf of a company, you represent that you are authorized to bind that company to these Terms.
DialogFusion is a customer communication and CRM platform that unifies messaging channels — including the WhatsApp Business Platform, Instagram Messaging, Facebook Messenger, Google Business Messages, and website live chat — into a single inbox, and provides AI-assisted replies, chatbots, automation, and lead management tools.
The Service connects to third-party platforms, including Meta products (WhatsApp Business Platform, Messenger, Instagram). By connecting these channels you agree that:

As between you and DialogFusion, you own the data you and your end users submit through the Service ("Customer Data"). You grant us a limited license to process Customer Data solely to provide and improve the Service, as described in our Privacy Policy. You are responsible for the legality of Customer Data and for having a lawful basis to process your end users' personal data.
The Service, including its software, design, and content (excluding Customer Data), is owned by DialogFusion and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You may not copy, modify, reverse engineer, or create derivative works of the Service.
AI-generated replies and chatbot responses are produced automatically and may contain inaccuracies. You are responsible for reviewing and supervising AI outputs used in your customer communications.
You may cancel your subscription and delete your account at any time. We may suspend or terminate the Service for material breach of these Terms, non-payment, or where required by law or a platform provider. Upon termination, your data will be handled as described in our Privacy Policy and Data Deletion Request page.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that third-party platforms will remain available.
To the maximum extent permitted by law, DialogFusion shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our total liability for any claim arising out of the Service shall not exceed the amounts you paid us in the twelve (12) months preceding the claim.
You agree to indemnify and hold DialogFusion harmless from claims arising out of your Customer Data, your use of the Service in violation of these Terms, or your violation of applicable law or third-party platform policies.
We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles, and disputes shall be resolved before the competent courts and enforcement offices of Türkiye. For questions about these Terms, contact us at aydin@birimajans.com.
